GOVERNING LAW
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. By using this site, you explicitly agree that any action at law or in equity arising out of or relating to these Terms of Use or the use of this website shall be filed only in the state or federal courts located in Seminole or Flagler County, Florida, at the discretion of Liberty Data and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
OPT-OUT AND DATA SUPPRESSION
At any time, you may request to opt-out of receiving any marketing communications by contacting us or choosing the “unsubscribe” option on any marketing communications.
Additionally, you may opt-out of any of our products if you are able to satisfy our requirements contained in our Opt-Out and Data Suppression Policy. Once accepted, your personal information will be suppressed for our products.
SPECIFIC RIGHTS FOR CALIFORNIA RESIDENTS
The California Consumer Privacy Act of 2018 (CCPA) provides California residents with certain rights regarding their “personal information,” as that term is defined in the CCPA. With limited exceptions, qualifying businesses must make certain disclosures to California residents upon making a verifiable request, including the categories of information collected by a business, the categories of sources of such information, the business or commercial purpose of collection, the categories of third parties with whom information is sold, and a right to obtain the specific pieces of personal information collected, as well as a right to request that a business delete the consumer’s personal information. Liberty Data collects the categories of personal information described in this Privacy Policy and provides some or all of it in our products and services offered.
The CCPA does not apply to certain personal information, including that which is collected, processed, sold, or disclosed pursuant to the Gramm-Leach-Bliley Act (GLBA), the Driver’s Privacy Protection Act of 1994 (DPPA), “publicly available” information lawfully available from a government source, and data that is deidentified or aggregate consumer data. Thus, many products and solutions offered by Liberty Data are NOT subject to CCPA.

California residents may designate an authorized agent in writing or through a valid power of attorney to exercise CCPA rights to access or delete personal information on their behalf. We will undertake good faith efforts to verify such requests and the identity of the requestors before acting on such requests.
The CCPA requires the authentication of any requests for removal of personal information. Thus, in order for Liberty Data to process a request, you may be asked to provide certain personal information including your name, address, mobile phone number, partial Social Security number and date of birth. Information collected pursuant to this request will be used for verification ONLY.
Once a request is received and verified, Liberty Data has 45 days to evaluate, respond, and if applicable, deliver the requested information. Given the number of requests and verification process required, Liberty Data may, at its sole discretion, extend this time period to respond as permitted by law.
Please note that you may not be discriminated against for exercising your rights under the CCPA. This includes denying you products or services, charging different prices for products or services, providing a different level or quality of products or services, or suggesting that you will receive a different price or rate for products or services or a different level or quality of products or services.
